Terms of Service

These Terms of Service ("Terms") govern your access to and use of entrica.co.nz and the Entrica visitor management platform, including contactless QR sign-in, the branded tablet kiosk, visitor pre-registration, host notifications, and the visitor dashboard (together, the "Service"), provided by Entrica ("Entrica," "we," "us"). By creating an account, requesting a call, or using the Service, you agree to these Terms on behalf of yourself and, if applicable, the business you represent ("Customer," "you").
1. What Entrica provides
Entrica lets a business set up contactless sign-in for its visitors, either via a printed QR code that visitors scan with their own phone, or a branded kiosk running on a tablet the Customer supplies. Sign-in data flows into a live dashboard with host notifications, a visitor log, pre-registration, and basic analytics. We may add, change, or retire features from time to time as the Service evolves.
2. Accounts and eligibility
- You must be at least 18 and authorised to act on behalf of the business you're registering.
- You're responsible for the accuracy of your account information and for keeping your login credentials confidential.
- You're responsible for all activity that happens under your account, including actions taken by staff you've given access to.
- Notify us promptly at [email protected] if you suspect unauthorised use of your account.
3. Your responsibilities as a host business
Because Entrica collects personal information from your visitors on your behalf, you agree to:
- Only collect visitor information you have a legitimate reason to collect, and configure your sign-in form accordingly.
- Give visitors any privacy notice required by law at your location (for example, a sign near your QR code or kiosk, or a link on your sign-in form).
- Obtain any consents required before enabling optional features such as photo capture.
- Use the visitor data you collect only for legitimate business, health-and-safety, and compliance purposes.
- Ensure your use of the Service, and the data you collect through it, complies with the Privacy Act 2020 (NZ), the Privacy Act 1988 (Cth), and any other law that applies to you.
4. Acceptable use
You agree not to:
- Use the Service to collect more personal information than is reasonably necessary for visitor sign-in.
- Reverse-engineer, resell, or white-label the Service without our written permission.
- Attempt to disrupt, overload, or gain unauthorised access to the Service or other customers' data.
- Use the Service for any unlawful purpose or in a way that infringes anyone else's rights.
5. Setup, fees, and cancellation
Where a paid plan applies, pricing and billing frequency will be confirmed with you before you're charged, consistent with what we tell you on our website (no credit card required to get started, roughly five minutes to set up, and no hardware required for QR sign-in). You can cancel at any time; cancellation takes effect at the end of the current billing period unless we agree otherwise. Fees already paid are non-refundable except where required by law.
6. Data ownership and processing
As between you and Entrica, you own the visitor and business data you collect through the Service. We process that data only to provide the Service, as instructed by you, and as described in our Privacy Policy. On request, we'll help you export your visitor log, and we'll delete your data within a reasonable period after your account is closed, except where we're required to keep it for legal reasons.
7. Intellectual property
Entrica and its licensors own all rights in the Service, including its software, design, and branding. You retain ownership of your own logo, forms, and content that you upload, and you grant us a licence to use it solely to operate the Service for you (for example, displaying your logo on your branded kiosk or sign-in page).
8. Third-party components
The Service relies on third-party infrastructure for hosting, data storage, and notification delivery (email/SMS). We select these providers carefully, but we're not responsible for outages or issues caused solely by a third-party provider that is outside our reasonable control.
9. Service availability
We aim to keep the Service available and reliable, including offline-capable kiosk mode for short connectivity drops, but we don't guarantee uninterrupted access. We may suspend the Service for maintenance, security, or legal reasons, and we'll try to give reasonable notice where practical.
10. Limitation of liability
To the maximum extent permitted by law, Entrica is not liable for indirect, incidental, or consequential damages arising from your use of the Service, and our total liability for any claim relating to the Service is limited to the fees you paid us in the twelve months before the claim arose. Nothing in these Terms limits any liability that cannot be limited under the Consumer Guarantees Act 1993 (NZ), the Australian Consumer Law, or other applicable law.
11. Indemnity
You agree to indemnify Entrica against claims, losses, or costs arising from your breach of these Terms, your misuse of the Service, or your failure to obtain a required consent or notice from a visitor whose information you collect.
12. Termination
Either party may terminate for convenience with notice as agreed at sign-up, or immediately if the other party materially breaches these Terms and doesn't fix it within a reasonable period after being asked to. We may also suspend or terminate an account immediately to protect the security or integrity of the Service.
13. Governing law
These Terms are governed by the laws of New Zealand, and the courts of New Zealand have non-exclusive jurisdiction over any dispute, without limiting the rights Australian customers may have under the Australian Consumer Law.
14. Changes to these Terms
We may update these Terms from time to time. For material changes, we'll notify active customers by email before the changes take effect. Continuing to use the Service after that point means you accept the updated Terms.
